Land Transfer from Builder to Housing Society?

Our builder has not transferred the land to society yet.   What action can society members take in this regard?

Is this builder's responsibility or society's responsibility?

What are the documents required from the builder in order to process this?

Does this require his consent or is it corporation's duty?

Dear Querist,

 

Please check the existence of any agreement between your builder and society for such transfer. If so, you have several civil/special law remedy including Suit/Consumer case.

As regards responsibility, please follow opinion as above.

Trust this would suffice.

ok. But there is no agreement between the society and builder.   I think the builder should process these. Is that right?

Who is make agreemrnt with U, Builder or Society? Who is the owner of the Property, Builder / Society? See the document and condition, If the owner is Society then in the revenue records is in Society name and then Society make a agreement / Allotment deed with u, so u check the document of the property and property title.
