Rights of husband while filing divorce..???

Hello everyone !!!

In a case of Arrange Marriage, if the Husband knows that his Wife was not truthful to him before marriage... What grounds/ rights does the Husband have for filing a rightful seperation/ divorce...???

Even the family from the Wife's side changed residences once the relation was finalised, so there was minimum scope of background check too.

This is a matter of breach of integral trust between the Boy and the Girl which they have to build before finalising the relation. They deserve to know any important past about each other before coming to any conclusion.

Kindly advice. Thank you.

hi

affairs before marriage is not a ground of divorce. If she has any affair now ie after marriage, if she/they has concealed some serious disease or her age then it could be a ground of divorce.

If your marriage is not performed yet then you have time and chances to inquire about her past instead of regretting after marriage.

Only fraud and concealment of such fact, which if known, would have made it impossible for the other party to give consent to the marriage are grounds for annulment/ divorce.

Not all concealments give right for filing divorce.

Issues of estate and property division usually arise when a couple decides to separate. Aside from real estate, the spouse can also claim a share of superannuation, employment entitlements, business interests, and other shares if the husband/wife wants a divorce. However, the Indian divorce laws provide some rights of the husband during divorce proceedings to ensure that the husband is able to file a divorce matter on valid grounds, refuse to pay maintenance to wife when she is not eligible and claim custody of the child. If you want to know more then you may consider the help of Janak law Firm.
