Sale agreement

Hi,

 

Can you please clarify on below things?

If at all, I want to sell my property (agriculture land) -

1. Registered Agreement is better or Unregistered is better or is there a way to sell the property by without agreement

2. Government  value of a property is 50 lakhs, whereas selling value is 1 crore. Buyer wants to pay 25 lakhs as advance and make the agreement with that amount. If this is the case, then as per agreement the buyer has to just pay 25 lakhs? 

3. If we specify 3 months to clear the pending amount and  then get the property registered. If he fails to clear the pending amount by within 3 months then how to handle it,

4. Someone was telling that without having the agreement, the buyer will not be able to get the land sketch copy and get the survey done. Is this true?

 

Please assist.

1. Registered Agreement is better or Unregistered is better or is there a way to sell the property by without agreement

Ans:-Agreement relating to sale is not a compulsorily registering document in the eye of law.You can straight away sell the property without entering into any formal agreement of sale.    

2. Government  value of a property is 50 lakhs, whereas selling value is 1 crore. Buyer wants to pay 25 lakhs as advance and make the agreement with that amount. If this is the case, then as per agreement the buyer has to just pay 25 lakhs?

Ans:-In agreement,sale consideration is fixed as Rs.1 Cr,buyer should oblige it.    

3. If we specify 3 months to clear the pending amount and  then get the property registered. If he fails to clear the pending amount by within 3 months then how to handle it,

Ans:-In that event,agreement would be cancelled provided specifically mentioned in the agreement.  

4. Someone was telling that without having the agreement, the buyer will not be able to get the land sketch copy and get the survey done. Is this true?

Ans:-If local rule says so,one has to follow it.
