Senior citizen civil case to be transferred to nearest court

Dear Sir,
Im here on behalf of my Father In Law who is almost 68 Years of age, he has filed property case against his brother, he has to travel 40-50 Kms to attend any proceedings, he is not in good health. I want to know if there is any provision in the court so that we can appeal for transfer of case to the nearest possible court.

Property related cases are tried in the court whose jurisdiction property situates,case can not be transferred on sympathetic ground.

Thanks a lot for both of you. Is it possible to move the case on senior citizen priority base so that the case ends soon.

A petition may be filed to that extent and it depends on discretion of the judge.  The judge may also consider as to whether there is any need for presence, when the case was entrusted to advocate in civil matters, and when there is opportunity of giving POA on his behalf.
