Sir, I stay in Noida , I have a small residiatial plot in Kakinda, Andhra Pradesh worth around 12 lakhs. Can I give an SPA to my maternal uncle who stays in Kakinada asking him to gift deed the same to my only brother ,who stays in Hyderabad . I cannot make a trip to Andhra right now ,so can i do it from Noida ? If so , what would be the cost and the time taken to do this. Thanks & regard

Hi Krushi,

 

Yes, you can execute Special power of Attorney in favour of your uncle and get it registered….

Make sure that your SPA deed specifically authorizes your uncle for doing so to that extent only (would be safer as legal aspect is concerned).

 

As far as cost is concerned the fee for getting it registered will be provided to you in your concerned Sub-Registrar office.

 

Try to incorporate these:

1.    “To execute a Gift Deed in favour of my brother (name of your brother)”,

2.    “To present before the Sub-Registrar and lodge the same for registration”; and

3.    “To complete all the formalities incidental and in-relation to the execution and registration of Gift Deed in favour of your brother”
