Action against Legal Notice

 Hello Experts

I have rather simple query here. I am sure I will get appropriate guidance.

Recently I have been served a Legal Demand Notice by my ex employer, putting all wrong and baseless charges. Before this ex employer also sent email to my clients putting false allegations with an intention to stop giving me business.

Now what legal actions I can take against ex employer apart from replying to a legal notice? Can I lodge an FIR followed by defamation case?

Thanks in advance!

U can lodge a FIR against the concern, but you should have enough evidence to prove, and the important thing you have to reply the Legal Notice accordingly.

 Thanks Mr Jena

I have enough proof in my defense.

Hi,

First of all u r talking about allegation which are defamatory in nature .So u can file a complaint case u/s 499/500 IPC.

U can file a FIR if cognizable offence will made out  but in abovementioed facts there  will be only defamation will be made out which need to be prove in court through e-mails .

Hi,

U may issue counter notice for taking civil & crimial action for defamation and makig injury to your business goodwill bringing false allegation and of course proof of falsity in Demand Notice is a must.
