ADMIRALTY RULES OF MADRAS MADE APPLICABLE TO KERALA TOO

The High Court of Kerala has in a recent judgment stream lined it’s already existing admiralty jurisdiction (as laid down in the decision of the Supreme Court in MV Elizabeth Case) by laying down the procedure to be complied with for invoking the admiralty jurisdiction. The Division Bench lead by the Chief Justice has held that cases invoking admiralty jurisdiction should be instituted in the High Court of Kerala as a suit in accordance with the Civil Procedure Code and should be tried accordingly. The Court also held that the Rules farmed by the Madras High Court with appropriate modifications and in so far as not inconsistent with any other law shall apply for the conduct of such suits till the High Court of Kerala modifies the said Rules.  JUDGMENT HAS BEEN REPORTED IN 2011(1)KLT904
