Advice required

Sir, I have been employed in a FMCG Pvt.Ltd. Company as Depot Incharge in one of the Tamilnadu District. Before completion of one year service, the company obtained my resignation and issued a showcause notice which I have replied. The company did not paid salary(2 months), bonus, leave wages and TA. I made a complaint with the Local Labour Officer, who invited the company official for discussion and after two hearings, the LO informed me to go the employer HO at Pondicherry and settle the matter or make a complaint with Pondicherry Labour Office for conciliation since the Appointment is issued from Pondicherry office. In the meantime, the LO took 7 months at this stage. I made complaint to the Pondicherry LO who advised me to continue the case with the LO of Tamilnadu district where the case started irrespective of Appointment citing that If a company is having regd.office at Delhi and employs an employee at Pondicherry, the employee need to file case with Pondicherry LO for any dispute and not to go to Delhi LO. Now the Tamilnadu District LO claims that he cannot do anything in the matter as the company is having registered office at Pondicherry and only Pondicherry LO can look into the case. My resignation is yet to be accepted by the Company. What should I do now? Venkatachalam K. chennai

Approach a competent and experienced Labor Consultant/lawyer/service lawyer at your location.

Your lawyer shall staisfy the LO that his contntions are wrong and shall provide the citations if required.In all probablities LO has been influenced.

If you have secured the response of the  the Tamilnadu District LO, in writing you may succeed in lodging complaint against LO.
