Asylum in canada

Asylum is a different subject to that of the court case. 

You pursue your case as per provisions of law through court. 

It is not so easy to get Asylum on the family issues and consequences due to trail in court. It is better you write  Indian Embassy in Canada and Canadian Embassy in India informing them facts and seek support to get justice, If your case is true and based on real happenings you may get him called off;  as also per your query the passport is already impounded means  he can be deported even.
