The NGOs are basically registered society and hence if its Rules and Regulations warrants that then there is no bar from legal point of view.

If It has been registered as Society under Societies Reguistration Act than brothers can no hold both post neither they can be founder members of NGO, if it got registered and Society registrar skipped to see it even though the NGO is not legal, its a clear law, if it is registered under Indian Trust Act it can, here brothers may take posts.
