Can a witness sign on 311 crpc

Good Afternoon, Folks

Is it possible for a parent to sign on behalf of victim on 311 petition in court? can any procedures be done through email? any rights that can be given to parent via email, that can help in court

You mean the victim is the defacto complainant?

If so, then there is no necessity for the defacto complainant to file a petition under section 311 Cr.P.C, the assistant public prosecutor will take care of it. 

The court will not allow others to file the petition unless the petitioner has authorised the other person by a power of attorney deed for this purpose

Power of attorney can be worked on.

The case is domestic violence

second case PP is handling and too many disceprencies have been noticed here too.

I am amazed at the way autorities take cases so lightly when a victim is so severely damaged.

Thank You, for your efforts.

The victim has the capacity to sign, the advocate stated he would sign and send it across to the junior. The victim cannot take undue stress as it can trigger her mental health issue, which takes a few years to settle down. Hence least pressure is put on the victim
