Can employer omit the continuous service

The employer has issued appointment orders in the year 1973 stipualiting condition that his services cannot earn gratuity etc., until accepted as full member of the establsihment.. After two years of continuous service acceprted as full member. Now, while calculating the tptal service, the initial service of two years have been omitted for gratuity.Is it not violation of gratuity act 1972.
