According to the Gratuity Act 1972, an employee is eligible to receive a gratuity amount after completing five years of continuous service at one organisation. The gratuity amount is paid to the employees once they retire, resign, or are laid off.

as per a ruling made by the Madras High Court, individuals who have completed 240 days in their fifth year of service are eligible for gratuity.

Under the circumstances, you will be entitled to gratuity treating the period of continuous service as five years

There is break in service of about 4 months before second time appointment, hence you are not eligible for gratuity.
