Charge framing

Dear All,

Is it absolutely necessary for the accused to be present at the time of Charge Framing of charges.

Can the advocate be only present on behaf of the accused?

Yes its necessary for the accused to be present in courts while charges are framed...............no let up.............& there is a formality too-  that accused deny the charges & trial is continued upon their denial.

Thanks Rajiv,

But I knew that the lawyer can also do it in case the accused cannot be present...can the accused not give an affidavit or the lawyer cannot do anything...

It is an absolute necessity?

Regards,

Vikram
