Generally, government employees are bound by strict rules and regulations which prevent them from engaging in outside employment or business activities that may conflict with their official duties.

Rule 14 of the Central Civil Services (Conduct) Rules, 1964, prohibits government servants from accepting any employment outside their official duties without prior permission.Moreover, the government employee may also be subject to the Official Secrets Act, 1923, which restricts the disclosure of official information.

In the absence of specific provisions, legal principles such as conflict of interest and duty of loyalty to the employer could also be invoked.

However, it’s crucial for the concerned employee to thoroughly review their service rules and seek formal permission if contemplating engagement in the construction of a power plant outside their official capacity to avoid legal consequences.
