death of a sweeper in a housing society due to high voltage wire

dear learned advocates,

Yesterday, there was a tragic and on the spot death of a sweeper in our housing society in pune Maharashtra state due to electricity shock from a high voltage wire. The chairman told him to sweeper the area where the incident took place.

The sweeper was hired through a private agency. But his company didn't take the insurance of the deceased

What action can the police take against the managing committee members, society manager, and other staff under criminal laws of the Crpc of Indian penal code

The MC members can request all members of the society to contribute some funds to pay to the deceased family.

thank you in advance for your valuable legal views.

The society can be made vicariously liable to the accidental death of the sweeper.

It is always better to properly compensate the family members and arrive at a compromise situatiion in order to avoid legal consequences.

Many thanks sir

Who must compensate  our MC members or contributions from all members of the society.

Best regards

The society or the association as an entity should enter into compromise,  however the contribution towards compensation can be collected from the members of the association.

The employer (Contractor in instant case) has to compensate LRs of the employee.

Apart from above,LR's of deceased seeeper may claim compensation under provisions of  Fatal Accident Claim Act from Maharastra Electricity Board and Municipal Corporation.

Agreeing with above, I would add that in case the members do not contribute funds [they will argue that it is duty of contractor as most of the memebrs are not aware of the responsibility of Principal employer], the the executive members will have to pay from their own pocket.
