1)there must be an adjudication 2)such adjudication must have beendone in a suit3)it must havebeen determined the rights of the parties in regard to all or any of thematters in controversy in the suit 4)such determination must be of a conclusive nature 5)there must be a formal expression of such adjudication.------dear students you will depend on this basics through out yr profession and so must commit to memory.------sr members pls add as teaching programme.

Difference between Power and Autority.


Autority Means-


Legal or rightful power; a right to command or to act; power exercised buy a person in virtue of his office or trust; dominion; jurisdiction; authorization; as, the authority of a prince over subjects, and of parents over children; the authority of a court.

 


Government; the persons or the body exercising power or command; as, the local authorities of the States; the military authorities.

 


The power derived from opinion, respect, or esteem; influence of character, office, or station, or mental or moral superiority, and the like; claim to be believed or obeyed; as, an historian of no authority; a magistrate of great authority.

 


That which, or one who, is claimed or appealed to in support of opinions, actions, measures, etc.

 


Testimony; witness.

 


A precedent; a decision of a court, an official declaration, or an opinion, saying, or statement worthy to be taken as a precedent.

 


A book containing such a statement or opinion, or the author of the book.

 


Justification; warrant.


Power Means

 



Power and authority are very important topics in understanding organisations and management, the


more so because they tend to be ignored by economic accounts. A standard definition of power is that


given by Dahl. The basic idea is that we have power over someone else to the extent that we can get


that person to do something that otherwise they would not want to do. That is, we can get someone to


act in a way that they consider to be contrary to their interests.
