Eviction of tenant

We have a trust property, in one portion of property an old tenant started raising construction , we objected and filed a suit for eviction on the ground that tenant has no right to raise construction, the tenant took plea that he has verbal permission from previous trustee who is not alive. the court ruled in favour of tenant. Is the court right. can we aooroach directly to High Court for directing the trial court for review of judgement.
