Since your father purchased the properties out of his own earnings - it becomes his seperate property- he could have executed a valid gift without any obstructions. If the gift was valid in other respects the gift w.r.t your brother's son would also be valid. However you can always try and allege the procedural as well as consent element of the divorce petition.
