Gratuity eligibility in karnakata

Hi ,

I worked in IT company for more than 4 years 240 days .And this company is going to close their operations in india in couple of months. By the closing day i will be completing 4 years 363 days. Recently Chennai high court told 4 years 240 days is the eligibility for the Gratuity.But Management is saying In Karnataka it is 5years for the eligibility to get the Gratuity.

Please let me know.

Karunakar..... You are advised to go through the terms & conditions of employment of your company at the time of your joining. Find out whether its is 5 years or 4 yrs 240 days. I think as per company act in your state, what ever the High court said should match the terms & conditions of your company. If it is 4 years 240 days, then consult a senior advocate to this situation.
