Gratuity eligibilty

I wanted to know if I am eligible for gratuity ?

I worked in an organisation for continuous 4 years and 6 months.

Organisation has 5 working days a week.

Please help me in this.

Count from DOJ to LWD.

You should have worked for 190days in 5th year.

Employer can pay by its sweet will, even if employee is not eligible.

I have 5 working days in week. so 190 days including sat/sun or only working days ?

also my DOJ was 21/10/2011 & LWD was 22/04/2016

190 days should include all off days/holidays/approved leave.

Prior to your leaving the organization in the preceding year if you've completed 190 days of working including paid holidays you'd be eligible as of right to demand Gratuity..

Your query was replied and reply is reproduced as below:

From DOJ to LWD you need to complete 4Y190D.

In 5th year you should have worked for 190D.

You need to calculate on your own.It is simple mathematics.

You may compute leap years.
