Gratuity to railway employees

dear sir,

 

I wife has completed 14 1/2 years of unblemished service in railways and resigned on oct 15 due to health problem.

Their HR people had told her that she is not eligible for gratuity.

 

As per Gratuity Act, gratuity is payable on completing 5 years.

 

Please guide.

here, you should see, in the act for the payment of gratuity an employee to be superranuated not retirement specially where, retirement of an employee due to disablement, disease or health problem etc. it all incapacitate for any worker to be an employee.

You are referring to Payment of Gratuity Act.

You should look and relate with detailed and comprehensive,Gratuity Rules applicable to railways.

You may relate and you will find the answer.

 

By the way, has the employee applied in writing,under proepr acknowledgment?

Has the employer applied in writing?
