One Real Estate service provider, is not registered in GST and doing in business in crores..

When he offered service to me, He collect money from me without giving official receipts. I have paid him in NEFT.

Since he is not registerd with GST, despite he is having busines over 5crores.

Now, I propose to file a case against the service provider for his tax evasion.

May I request the Experts to kindly advise, how to file a case against him for not providing the GST bils and his motive of intentioonal tax evasion.

In response to your query,

Because the term "penalty" is not defined in the GST, it derives its meaning from a variety of judicial declarations and jurisprudential considerations. A penalty is a legal punishment for breaking a law or failing to do something that was a party's responsibility. Penalties can be either corporal or monetary, civil or criminal in nature. Under the GST, there are both bodily (jail) and pecuniary (monetary) punishments.

But you can file a case against him for not issuing an invoice/receipt.

Penalty for this is 100% of the tax due or Rs. 10,000 whichever is higher.
