Interim and final order

Hi friends,

In DVC Case, Interim Orders were passed and were confirmed by Sessions Court and High Court in Wife's favour. (on Appeal by husband).

So, at present only Arguments from Respondent is pending in main case.

Whether the final Orders will be passed by Magistrate pending MP for Interim Maintenance.

If passed, how arrears will be mentioned in Final Orders.

1. First wife will press for Interim Protection Orders and pray for clearing arrears after confirmation in favor of aggrieved person / wife by HC and against the appeal of respondent as per the Order in a Appeal. DV Court will not carry forward to Final Argument till then.

2. The further proceedings (final arguments as you say) will get further delayed and so will more arrears pile up till they all are not cleared.


There is not much Respondent can do other than seek permission to file SLP in SC against some potent errors in HC appeal if any or beg complainant for MCD where with leave of DV Court arrears can be clubbed in one time alimony.

It appears that since the appeal is only aganst the interim order, there is no bar that the main proceeding will not proceed. In the final ordfer the Judge will see that the interim relief given if paid or not, if it is not paid the whole thing will be calculated in the final order.

If final order is still pending than it is Interim maintenance order. Final order will be decided on the marit.
