Maintanance

Hello,

Would like to know how mainatnance or interim maintanance is decided in court??Wife is B.Com should still husband need to pay maintanance as she is graduate??There are two kids out of said wedlock of 6 years and 4 years??What is maximum mainatanance in this case??Since wife is also graduate and her IT writtens are filed will responsiblity of one / one childern on both parents mean 1 childs maintatnance to be paid by wife and one by husband??can wife ask for her lawyers fees as well??

Even if she is a graduate and earning well and if you cant prove that she is earning enough to lead a comfortable life you would end up paying maintenance to the wife.as far as the maintenance to children is concerned you got to definitely pay

If court orders 1000, whether wife is eligible to get alimony or not, she is well qualified once it is proved that you both are married.  However, you pay 1000 to her or the kids its one and the same as mother will be caretaker. Increase the same in multiples of 100.

Maintenance depends on income of both parties. Is your wife working, do you know where ?

Even if you dont have her salary details the same can be asked to be produced by the wife through the court. Also if she is educated and worked in past there is a way to stop/pay her less maintenance. So more details on ur salary and her income /educational details are required to advise in precise manner.

If she is working and getting good salary she may not entitled to maintenance for herself but for kids you have to pay maintenance. Try to gather her salary details . Your maintenance case depends upon your income, her income / education & your kids expenditure .
