A is the proprietor of the company, B is younger brother of A.

A signed an agreement with C for services. After the amount is due of services delivered, C deposited the cheque issued by A. And the cheque is dishonoured.

Here the cheque is in the name of B.

So the question is, to whom C could send a demand notice.

Notice is to be sent to drawer of cheque( Mr. B ).

 A legal notice is to be issued to the drawer of the cheque because he is the one liable for payment towards the cheque amount.

In the pleadings it can be mentioned that the drawer of cheque has issued the cheque to clear the laon amount of his brother undertaking the responsibility.
