Not compatible to stay together

Husband and wife fought so frequently and wife couldn't take it so she left his house n stays with her family. husband immediately stopped giving maintenance to her and filed a case under desertion. wife is helpless n she doesn't wanna stay with him anymore as both r not at all compatible to stay together. no kids..she failed to appear at the court for hearing, now it has been more than a year..so what will be the solution for this..she needs a bit of maintenance till she finished her education.

Quesry is not clear:

U mean 2 say that he was paying maint. & now stopped, under what act he was paying?

How come he file desertion in such a shor span of wife leaving him?

yeah husband was looking after her by giving maintenance when they were staying together..then after the fight wife left the house n stays with her family..so since she left the house husband stopped giving maintenance i.e stopped transfering money to her account... then after 6 months he filed a case under desertion..

i hope my explaination is clear now..

For desertion, you need to proove minimum two years of separation period, was that met??

If two years of separation period was met, then approach court for divorce, good thing you deposited money in bank for year, hence she cannot claim that you failed in your duty. So approach court to seek divorce.
