Dear Sir,
One of my colleague resigned from my organisation on nov 2011. She had joined us on july 2006 and got confirmed in july 2007. During the provision period her salary was consolidated but after her confirmation she was under a grade and she had proper break up of her salary. During her resignation the company refused to pay her gratity because initial one year the company treated her as contract employee and her salary was consolidated. Is the company legally correct? What should she do?
