Proof of working if no salary slip is available.

 

Dear Experts,

 

How to establish in the court that wife is working, in case she is taking salary in cash or anybody elses name.

Is confirmation from other employees or certificate by Oath Commissioner that she has been seen working in the office are acceptable in the court.

Any other advice.

You will need salary slips issued by the employer.

Even if the salary is given in cash,there must be some proofs maintened by the employer.

If you dont have any salary slips then serve the summons to the manager in whoes under she is working.They maintain these( salary slips ) proofs.

You will have to bring on record some documentary proof, it may be in the form of income tax return or some other relevant document like salary slip or certificate from employer....you will have to summon the witness and record.Plus,you will have to search the record of other offices like IT.

If you are sure where she is working, file an appliction u.s 91 of the CrpC praying the court to send summons to the head HR of the company asking for proof that she is working. 

 

Mention that she has filed false cases in order to extort money and hiding the fact that she is earning.

 

The court will issue summons to the concerned company asking for details. After receiving summons from the Magistrate, the HR will not wait a second longer, but send the detials to the court.

 

Make sure you make the applications properly and argue the matter in the court if required.

It is not SALARY SLEEP..IT IS SALARY SLIP. The salary does not sleep...for your kind information..

And being an advocate you should have explained him..how to get the summons served..he cannot do it himself...right?
