i had taken a site in auction in chandigarh in the year 1973. The site was to be used for commercial trade and no restriction on use of basement. The laws were ammended in 1993 where by the use of basement was restricted to storage / machine room. fdurther the use was allowed for commercial activities after paying fees.
My contention is that the ammendment came much after the date of auction and the ammendments or the parent rule does not provide for retrospective application of ammendments. The said ammendment is not applicable to me and the use of basement will be governed by the laws as on date of auction.
Please advice and give judgements of The Hon'ble SC or HC to support my case
