Sec 328 of IPC is non bailable offence and triaable by Session Judge Court.

The offence for administering stupefying drug with intent to cause hurt punishable with 10 years imprisonment and fine under section 338 IPC is triable by the sessions court.

s.328 IPC is an offence against the body (causing hurt by means of poison). It is a grave crime and is triable by the Court of Sessions. This offence is non bailable, which means bail does not come as a right to the accused.
