Hi All,
The son had payed a total of INR 3.3 lakhs to dad as part of the education charges. Now the dad has again put a section 125 of crpc against the son for monthly maintenance.
As per law, providing education to son is dads responsibility and the son need not pay back.
Please let me know whether i can claim back the money paid to my dad and moreover the dad has 2 properties

Hi,
Yes i have proof that my father owns both the properties and he was also working during the same period.
Yet still he has taken back all the money from me. So please let me know whether i can ask for my money back.

Then he should not get any maintenance.

any proof of income from the properties? rental etc?
contact a good lawyer , u can claim giving him 3.3 lacs as maintenance too.

Can you also please let me know on what basis one calculates the maintenance amount to be given ... for example 10% of salary etc....

There is no mathematical formula. From the facts discretion of the judge evolves.
