Trademark agent

An Advocate and a Company Secretary can act as Trademark agents ??? Am i right please correct me ???

Hi,

The person is eligible to apply for the examination under the Trademark Act 1999, if he has completed 21 years and should be a graduate in any university in India or any other equal qualification or should hold a degree in law

Yes Advocate & CS can act as Trademark Agent. Usually IP matters like Trademark, Copyright, Design, Patent would require enforcement, apperances in Civil Court. Hence, it would be advised to prefer an Advocate with good IPR knowledge.

particularly if I am handling my clients’ application, prosecution and attending hearing in tribunal and Although I do not want to come into litigation part of IPR, but I want to know, can Practicing Company Secretary appear in Civil Court for these matters
