Two Unlicensed Driver Bike Accident

TVS XL and Bike Accident :

Both dont have license and Insurance,


Bike person age 22.

TVS driver age 55 ( Drinks and Drive ). He is serious in Hospital.

If Police put Case / FIR on both , is there any issue for guy with Bike,he is adult , it will affect his future .

How to solve this issue ?

The motor vehicle (amendment) act 2019 came into force on September 1, 2019. This amendment has made severe penalties against unlicensed drivers. Under Section 133 of the Motor Vehicles Act, you will be punished if you don't carry the necessary documents like driving license and vehicle related papers. Under the new traffic rules, driving without a license will lead to a fine of ₹5000, and if you don't have a vehicle permit, it will lead up to a fine of ₹10,000.
The amendment also allows people to carry a digital copy of the necessary documents, by removing the provision that people need to carry hard copies of the same.
Therefore, both of the drivers in this situation will be liable to pay the fine for unlicensed driving.
The new traffic rules, after the amendment also punishes drunk and driving with a fine of ₹10,000, and/or imprisonment for upto 6 months for anyone who has committed the offence for the first time, and if it's the second time, the imprisonment term will be for 2 years, and/or the person will be liable to pay the fine of ₹15,000.
