Validity of video audio evidence that are older than 5 years

Hello Lawyers,

If video and audio recording older than 5 year is admissable in the civil suit? ..and if not can we exhibit them before expiry and before evidence stage to avoid admissibility issue?

Dear Querist,

Section 65A and Section 65B of Indian Evidence Act, 1872 states that electronic records are admissible as evidence. In your case both video recording and voice recording are electronic evidences and are thereby admissible in court. There is no expiry period for these evidences the only think you have to keep in mind is to submit evidences during the stipulated time given by the court to do so. Also, while submitting the electronic evidences, it is necessary to note that the voice must be clear and recognizable, there should be no alteration to the recordings. The evidences provide must be kept sealed in custody.
