Will the aggrement be vaild after the expiry

Hello Sir,

 

Buyer and Seller made an agreement on 100 rupee stamp paper to lock the seller from selling the property to any other party who offers higher price. Buyer is unable to mobilise the money even after the 2 months time frame that was agreed upon and mentioned on the stamp paper. Now the owner is selling the same property to me.

Is it legally okay for me to buy the property?

Does old buyer has any legal rights on this property? He still has that original agreement paper with him.

And also owner is not willing to sell the property to old buyer. Owner is ready to refund the money he took during the time of agreement.

As a new buyer what measures should I take?

Please note that this is not a registered documents. Just written an agreement on stamp paper signed by buyer, seller and 2 witnesses.

Please help me in this regard.

No problem to buy , get Agreement egistered, and have possession.

 

To be extra cautious, ask ytour Lawyer to Pblish Pblic Notice inviting claims if any
