do i need poa to evict tenant

Hello All,
Please Advice me
We me and my brother have a ancestral house in Rajasthan. We have one tenant for past18y with no written contract. The tenant has his own ancestral property land & house is same district 15km from my house. both brothers want to evict tenant. Do I need POA or NOC form my brother, because he did not want to involve in court process. Pls advise how to approach.

No you can evict the tenant on your own without a POA or NOC from brother. Consult a local advocate who would after seeing whether your tenant's is a protected tenancy or not advise you on how to proceed further
