rent agrement

Sir,
I have rented a property to a government insurance company and in the rent agreement it is written that they can cancel the lease by giving 3 months notice and there is no such clause in our favour.

Please guide me how to enforce this clause in our favour also as this clause is in their favour and it becomes one sided agreement.

You can ask the company to execute an amendmend agreement to the lease deed stating that you too can terminate the agreement by giving 3 months notice

It may be their intention. Many of the govt establishments enter this type of agreement only. (i.e) they only can terminate the rent agreement, not the landlord.

if you had any objection you should not have entered into rental agreement . the agreement as it stands is binding upon you . when you go in for renewal try to renegotiate

Clause is maintainable and valid in the eye of Law. Moreover, at the time of agreement, you can force such clause.

You can cancel the lease in these circumstances anyway-
1. On efflux of time,
2. on breach of terms in the lease deed.

It is the prerogative of the company now to amend the lease deed or not so put only your case before them and wait for their response otherwise true speaking, you have no remedy now.

In the absence of such a clause in your favor,you can not cancel the lease applying this clause in your favor.Unless some default is committed by the lessee company,or you create rapport with officer of the branch showing your needs for the premises and he cooperates with you.
