Yes,An unregistered partnership firm can very well file complaint u/s 138 N.I.Act. Sec. 69(2) of Partnership Act applicable only where civil rights are involved and not in criminal cases. Sec.138 of N.I.Act is penal provision. Non registration of firm has no legal bearing on the criminal case.

You can file case against unregistered firm but un regd partnership can not file any case., except among partners.
