My client has purchased a non judicial stamp paper on Feb 1997 and till today he didnt use the paper, can he use that stamp paper for a new agreement on this day as per the andhrapradesh state rules. Please advise me.

in maharashtra validity of stamp paper is 6 months . it is better you check with local lawyer whether stamp paper of 1997 would be valid now . better purchase a new stamp paper to avoid controversies

Sir please analyze following citation- In this judgment held that stamp paper is valid as currency for life time.

Expiry date of stamp paper- Use of stamp paper for execution of agreement to sell- no impediment for stamp paper purchased more than 6 months prior to proposed date of execution being used for document- Stipulation of period of 6 months prescribed in Sec 54, Stamp Act is only for purpose of seeking refund of value of unused stamp paper and not for use of stamp paper- SC-CLJ-2008-211

Thank you for the response, the stamp paper is of Rs 25,000/- valuation & the paper doesn't get refund because it is more than 6 months. That is the reason my client want to use it but is there any limitation as per A.P rules.
Raj Kumar Makkad (Expert) 11 July 2013
The validity of 6 months is for the purpose of writing thereon and registration. There is no limit to use those stamp papers.

My client is a complainant in 138 NI act, my complainant filled the promissory note and cheque by the instructions of the accused but now the accused is saying that he has given blank cheques and promissory notes so the judge is saying the burden remains on the complainant and citations to prove, so please give me citations which help me in this case.

the burden is on accused to show that blank cheques had been give by him and that material alterations have been made by the complainant . since you are an advocate search for citation in indian kanoon . com
