You have to see what evidence/ witnesses the prosecution has to prove rash and negligent act. There can be no general defence.

The prosecution has to prove that there is a rash and negligent act of driving on the part of the driver. In most of these case, the accused gets let off on payment of fine.

If it a case under section 337 or 338 the Accused will be let off by payment of fine generally as my friend said but if it section 304A the accused will receive a sentence of imprisonment
