Can crediter freeze public goverment teacher salary bank account.

Safiya begum who is aasitance teacher has been guarantor for loan amount 118 lac now bank got 101 certificate under MCS act bank have given notice to SBH bank where safiya begum holding her salary account to freez the account , now bank has freez her account under MCS 156 act , can bank or crediter has authority to freez salary account , would it not against mimum wages , salary exempted under attachment and sale in execution of decree

It is neither a case of minimum wages, nor of attachment of salary at source. Freeze of salary account maintained by bank does not fall within the scope of minimum wages or attachment of salary by the court of law. She may intimate some other bank account as salary account to her employer for the purpose of credit of her salary in future.

Court or Income tax authorities can attach an account for recovery.

She can ask employer to disburse salary through some other account.

Open another a/c and request to credit salary in new a/c under proper acknowledgment.
