Family property issue

Querist : Anonymous (Querist) 24 November 2024 This query is : Resolved
My grandmother is the owner of the property which was purchased by my grandfather on grandmothers name.
My grandmother have 3 sons and 1 daughter
1 son stays with grandmother
All of a sudden we came to know that my grandmother has sold the property in exchange of money to her daughter in law without our concent.

*Grandfather is no more
*2 sons stays outside and daughter is married
*Self acquired property
*We have a medical certificate which states that grandmother was unwell or mental issue before selling the property.
*My grandfather had signed a will if favour of my one uncle who stays outside
Is this valid?

Can we file a case on this or what all we can do to get the property.

If the property was your grandmother's self acquired property then being the absolute owner she can sell or alienate her own property at her will, nobody can claim any share in it as a right neither anyone can challenge this sale of property.
Neither you nor your father or anyone can challenge this sale of proper by your grandmother.

Your query is confusing, how your grandmother became owner of property when it was your grandfather's self acquired propert? If your grandfather died intestate then his property rights devolve to his all legal heirs equally and your grandmother had no right to transfer( sale ) other legal heirs share and such sale can be challenged.

Grandfather had purchased the property ( plot) on my grandmothers name.

Then it becomes your grandmother's self acquired property.
You don't have any rights in the property neither your father.

Yes. Your grandfather purchased the property in the name of your grandmother; hence, she is the absolute owner of the property and can transfer her property to anyone. No one has a right to the property.

The sale is valid and legal where your grandmother was absolute owner of the property.
