This query is : Resolved
in a police investigation u/s 406, 420 , i.o. demanded original documents from complainant of F.I.R. for investigation purposes and issued notice u/s 91 cr. P.c. to complainant. Complainant while giving original documents desired receiving from i.o., but i.o. refused to give any acknowledgement on the plea that there is no such procedure of giving any receiving. Complainant instead provided self attested documents, but i.o. not agreed. Please advise the complainant .

No document whether original or photocopy cna seized by IO without providing for ' seizure list'.
So do not supply originals unless the IO supplies seizure list.
The IO is wrong in this case.

The IO is bound to give acknowledgement when sought. Absence of procedure is an insufficient excuse. You may take up the issue or you may seek information under RTI as to the law which authorises Police officers etc. to seek valuable documents and receive the same without issuing any acknowledgement.

Thanx experts. It means i.o. has to give receiving, otherwise complainant can refuse to give document.
