Admission of child girl custody with mother. is fathers name or mothers name mandatory for admission

is father name mandatory or mothers name mandatory especially for the girl child who is in mothers custody.

The parents are seeking divorce from wed lock and are in courts.

Mother is approaching admission in Srinagar her parental house is in Srinagar , and father is refusing to agree to keep in Srinagar and wants the child to be in Delhi or any Boarding school on which the mother and Father did not reach mutual understanding

As the mother was under threat of child being taken away she approached Srinagar courts and got interim custody.

Now being single woman she approached school in Srinagar and got admission to the child on that basis and school accepted the admission as mother is mandatory in the school and not fathers name is not mandatory in such cases,

the same is being challenged by the father.

i need to know the legal position of the same that admission is legal on mothers name being taken as mandatory by the school.

In such cases the custody of the young child, especially girl child would be given only to the mother. Therefore, if mother has admitted the child in Srinagar school there cannot be any objection. Just because the father is opposed to the admission of the child in Srinagar and yet the school admitting the child in Srinagar would not make it as ILLEGAL.

Agreed with Mr.Anirudh. Father can not challenge the admission. Admission is not illegal. But father has right to say that his name should be written as father of the child.

If custody of the child is legally with the mother then she is free to take entire decisions as per her free will and wishes but it shall be better if the wishes of the father ofthe child are also taken care as he can become unable to execute his visitation rights and thus the order of the court shall become falsified or irrelevant.
