Allotment letter and sale agreement

Builder has issued allotment letter to a buyer some 20 years back against payment but no sale agreement done and recently sold same flat to another buyer and registered agreement! What are the rights of new buyer who is unaware of previous allotment and bought flat now? Can buyer with allotment letter claim the flat? Please guide. Regards

Criminal case against the builder need to be initiated.
Dispute on the property has to be decided on merit by the court.

The first buyer has not done any agreement so can he claim the rights on the property?

He has paid the proceeds, possession is with him, builder has done criminal act.
