Greetings All,
My name is Senthil. I got married in NOV 2014 and we hardly stayed together, due to several misunderstandings, we separated. I was being too honest and filled the application for passport as Separated. I did not know the annexe K factor. I don't know any judge here to get it attested, it says it needs first class magistrate or executive magistrate attestation on non-judicial paper. Please can someone help me on how to go about this? My passport is expired and I badly need a new one. Any help will be much appreciated. I can be reached at 9902518856.

Meet a local lawyer, he will manage to do the needful.

Generally such attestation needs to be got done from an Executive Magistrate i.e. District Collector, RDO, SDO, Tahsildar etc.

Have you separated / divorced through court or any case regarding divorce is pending?
Get it attested from executive magistrate. In Haryana local Tehsildar is having powers of executive Magistrate, may be same position in your state also.
If you feel difficulty, take help of local lawyer.

Well, her dad has just sent the rough draft of the mutual agreement. I have to read and appear before their lawyer to sign it. So at the moment, I cannot legally prove that I am single/seperated/divorced. In one of the forum here I happened to read a lawyer asking why did you fill Separated as the status, to a different person though. He was right, I should have opted for single, sometimes truth comes with it's price. However, I will not lie at least this I have to follow (one of my dad's principles). I am not sure if I can approach a magistrate directly, like you all commented, I shall meet a lawyer and seek his help. Thanks a ton guys, for a evening, I felt like end of the world, because without passport I cannot even search a new job.

My suggestion is that for the present you may stop processing the passport by writing a letter to the authorities to cancel your application as withdrawn with leave to apply for it at a later date. Once it is cancelled, expedite the mutual consent divorce and after getting the decree apply for passport afresh with status mentioned as divorced, attached the copy of the decree and get your passport issued without any problem. For getting the anex-K attested you may have to approach RDO because the Judicial magistrates generally dont sign them.
