Appeal after issuance of contempt

(Querist) 02 February 2012 This query is : Resolved
Can the Government move the High Court in Appeal against the Order of a Central Administrative Tribual(CAT) after Contempt of Court proceedings have been intiated against the Govt. for the wilful non-implementation of the said order of the CAT within the time frame fixed by the CAT?
Raj Kumar Makkad (Expert) 02 February 2012
Yes. govt. has also similar right to go in appeal against the order of CAT like an employee.
Devajyoti Barman (Expert) 02 February 2012
Ever party to a case has right to challenge the order of a court of Tribunal to its appellate forum.
It is a legal right which can not be waived or restrained.

I am sorry if I left this query incomplete in any aspect. The Right to Appeal by the Govt has never been doubted by me. This is a simple case where the orders of the CAT were not implemented even after lapse of several months of the deadline fixed by the CAT.However when the Contempt Proceedings were intiated against the Govt Respondents, the Govt woke up from its slumber and decided to appeal against the CAT Judgement. Anyways thanx a lot for the replies.
