This query is : Resolved
If a wife files an RCR petition, then if in that petition 2-3 false small/petty cruelty issues are also stated, then are they relevant to be discussed in the court. What if my wife's advocate elaborates on those issues in the court.
Though, my wife wife is having no strong evidences as to the cruelty issues stated in her petition, then will the court hear her complaints regarding cruelty.
After all she has filed an RCR against me and not me that means she is telling the court that my husband is staying away from me and neglecting me without any reasonable cause/excuse. So, are cruelty complaints without evidences relevant to be discussed in the court.

lawyer can argue on number of issues . if court finds it relevant it will consider these issues while passing judgement .
your wife has to prove her case .

In RCR , it is quite commonplace the reference of those cruel acts.
After all it is the cruelty which cause the leave of one spouse without any reasonable excuse.

"So, are cruelty complaints without evidences relevant to be discussed in the court."
How can you anticipate just now your wife cant prove those issues, has the evidence been adduced and you your self has judged it as not proved????
It is better not to speculate,if have engaged a lawyer.

Come on real issues rather to these petty matters. You have to decide whether you are intersted to restitute your conjugal rights with your wife or not?
If not oppose the petition and if yes then make a compromise and all allegations shall be ignored.

Statement is different, evidence is different.
The applicant can make any statement and it will be perused by the court. Once it is proved by evidences only, the suitable relief can be obtained.
