RESPECTED MEMBERS
I WANT TO KNOW TO SUBMIT EVIDENCE OF COMPLAINANT THROUGH AUDIO VIDEO PROCESS IN 246 OF CR.P.C. AS MY CLIENT IS OUT OF INDIAN AND CANT ATTEND THE COURT
DATE IS FIXED FOR EVIDENCE OF COMPLAINANT US 246 OF CR.P.C

If the Court sends summons to him he has to come down to India and let in all relevant evidence both oral and documentary, Electronic evidence although admissible under Indian evidence Laws, it is not conclusive as yet in India -in proof of one's case.If you wish to thank me for this reply please click the Thank you button on my profile.

The audio or video evidence is not permissible in the given matter rather a local commission can be got appointed if permitted.

Appoint advocate commissioner to record the evidence. Till now only the production of under trial is made through video conferencing.

file an application before court u/s 65B of Indian Evidence act & get permission to file the electronic evidence on record. if court permit then you can file the same.

respected members
actually its a case of n.i. act i ve filed the case in cjm court ,court issued summons to accused,he got bail,now case is fixed for evidence of complainant us 246 of cr.p.c
now here is the problem that my client is not in india now, he is out of country n will come after 1 year and court asking me to notpress the case
now my question is that can i ve option to produce his evidence through skypee or other audio video methode if yes tha what will be the procedure
